- Organisation
Organization The company LES HERITIERS H CLEMENT simplified joint-stock company, with a share capital of 13,515,000.00 euros, whose registered office is located at Domaine de l'Acajou 97240 Le François, registered with the Trade and Companies Register of Pointe-à-Pitre under SIREN number 303 164 628 (hereinafter referred l’Organisatrice to as the Organizer") is organizing from 13 to 19 March 2023, a random draw with no obligation to purchase.
- Participants
This operation is open to natural persons, major, domiciled in the following countries: Denmark, France, Germany, France Hexagonale, Italy, United Kingdom, who have duly completed the participation form accessible by QR Code, during the period from 13 to 19 March 2023. (Hereinafter referred to as the Participants or the Participant »).
Are excluded from the game, persons who do not meet the conditions set out above, members of the staff of the Organizer, as well as any person who has directly or indirectly participated in the design, realization or management of the game as well as their spouse, members of their families: direct ascendants and descendants or other relatives living or not under their roof.
Legal persons are excluded from the game.
The Organizer reserves the right to ask any participant to justify the conditions set out above. Any person who does not meet these conditions or refuses to justify them will be excluded from the game and will not, in case of winning, benefit from the prize.
Participation in the game implies full acceptance of these rules.
- How to participate
Participants must, during the period from 13 to 19 March, complete the entry form available on the http://www.clement-tipunchweek.com siteThis link is accessible via the QR Codes on the flyers.
The information relating to the surname, first name, telephone number collected on the entry form is valid for the identity of the Participant in the draw.
Any entry made contrary to the provisions of these rules will make the entry invalid. Any participant suspected of fraud may be excluded from the game by the Organizer without the latter having to justify it. Any identification or entry that is incomplete, erroneous or illegible, intentionally or not, or made in a form other than that provided for in these rules will be considered void.
The person drawn at random may be accompanied by the adult natural person of his choice.
- Endowment
The prize at stake during the draw is as follows: a trip to Martinique.
The package consists exclusively:
- 2 rounds trip Paris/Fort-de-France in economy class for 2 people with Corsair ;
- Pre-routing from the winner's departure city

This price does not include (non-exhaustive list):
- Drinks, restaurants, and other amenities.

Designation and announcement of winners

The winner will be notified by telephone using the contact information collected on the entry form from March 21 , 2023.
In the event that the winner drawn at random does not appear within 15 days of notification of the results, he will lose his status as a winner and the Organizer reserves the right to dispose of his prize at its convenience by deciding in particular to award it to a substitute winner designated during the same draw or to put it back into play during a future operation.
- Delivery of prizes
The Organizer will contact the winner to arrange their stay. The winners agree to accept the prize as proposed without the possibility of exchange or reserve in particular against cash, other goods or services of any kind whatsoever, or transfer of the benefit to a third party. Similarly, these lots may not be the subject of a request for compensation.
The Organizer reserves the right, in the event of the occurrence of an event beyond its control, in particular related to its suppliers or unforeseeable circumstances, to replace the announced prize with a prize of equivalent value. Winners will be kept informed within a reasonable time of any changes.
- Protection of participants personal data
We inform you of the processing of data concerning you, in accordance with Articles 12 and 13 of the General Data Protection Regulation (GDPR), and Article 32 of the Data Protection Act of 6 January 1978 as amended.
- Purpose of processing (purposes and legal basis):
The data collected by the Organizer on the ballots are only used for the allocation of prizes and the realization of prospecting actions.

- Identification data: surname, first name, date of birth (for age verification), telephone number (to inform the winner), email (if the winner cannot be contacted by telephone);
- Data relating to the organisation and processing of competitions: the date of participation and the nature of the prizes offered;
Recipient of the data
Within the limits of their respective attributions, and according to your prior consent, may have access to your personal data:
- Authorized personnel from the marketing department, the security department, the sales department, the departments responsible for handling customer relations and prospecting, administrative services, logistics and IT departments as well as their line managers;
- The authorized staff of the services responsible for control (auditor, departments responsible for internal control procedures, etc.);
- Authorised personnel and partners whom LES HERITIERS H CLEMENT may call upon for the organisation of the competition (also called subcontractors).
Data retention period
- Identification data, data relating to the organisation and processing of competitions: kept for a period of 12 months from the end of the promotional operation;
- Data necessary for the realization of personalized prospecting actions: 3 years from their collection via the invoice.

All requests must specify the reason for the request, the company concerned by the request and the address to which the response must be sent. - Industrial and intellectual property
The reproduction, representation or exploitation of all or part of the elements composing the game, including these rules are strictly prohibited.
Any unauthorized reproduction, total or partial, of these trademarks, logos and signs constitutes an infringement punishable by sanctions.
- Responsibility
The Organizer cannot be responsible in the event of force majeure or fortuitous events beyond its control.
The Organizer cannot be held responsible for delays, losses, thefts, damages. It can not be held responsible either and no recourse can be taken against it in the event of occurrence of events presenting the characteristics of force majeure (strikes, bad weather ...) partially or totally depriving the Participants of the opportunity to participate in the game and / or the winner of the benefit of the winnings.
The Organizer and its service providers and partners can in no way be held responsible for any incidents that may occur in the use of the prize by the beneficiary or his guests once the winner has taken possession of it.
Similarly, the Organizer, as well as its service providers and partners, cannot be held responsible for the loss or theft of the prize by the beneficiary once the winner has taken possession of it. Any additional cost necessary to take possession of the prize is entirely the responsibility of the winner without the latter being able to request any compensation from the Organizer, nor from the service providers and partners.
- Claim
These rules are governed by French law.
The Organizer and the customer undertake to find an amicable solution to any difficulty that may arise as to the interpretation or application of these rules, it being understood that no dispute will be admitted in particular on the terms of the game, on the results, on the winnings or their receipt, one month after the end of the game. Except in the case of obvious errors, it is agreed that the information resulting from the game systems of the Organizer have probative force in any dispute as to the connection elements and the computer processing of the sites information relating to the game.
Any claim must be sent within one month of the end date of the game to the Organizer. Any complaint made after April 20, 2023 will not be accepted.

- Amicable settlement of disputes
The Organizer and the Participant undertake to try to settle their disputes amicably before referring the matter to the competent Court.

For the referral to the CMAP to be admissible, it must include: the Participant's postal address, email and telephone number as well as the full name and address of the Organizer, a brief statement of the facts, and proof of the preliminary steps taken.
Conformément aux règles applicables à la médiation, il est rappelé qu’un litige de consommation doit être confié préalablement par écrit au Service Client de LES HERITIERS H CLEMENT avant toute demande de médiation auprès du CMAP.
Ne peuvent faire l’objet d’une revue par le médiateur les litiges pour lesquels, la demande est manifestement infondée ou abusive, ou ont été précédemment examinés ou est en cours d’examen par un autre médiateur ou par un tribunal, ou si le consommateur a introduit sa demande auprès du médiateur dans un délai supérieur à un an à compter de sa réclamation écrite auprès de LES HERITIERS H CLEMENT ou si le litige n’entre pas dans le champ de compétence du médiateur, ou enfin si le consommateur ne justifie pas avoir tenté, au préalable, de résoudre son litige directement auprès de LES HERITIERS H CLEMENT par une réclamation écrite selon les modalités prévues, le cas échéant, dans le contrat.
